A society is an association of persons united using a mutual agreement to deliberate, governs, and acts cooperatively for communal purposes. Societies are registered to advance charitable activities, like sports, music, dance, art, etc. It’s objective to provide non-profitable services. Society Registration Act, 1860 are regulating society’s registration and operation. This article describes the process and Eligibility for Society Registration in Uttar Pradesh.
Societies Registration (Uttar Pradesh Amendment) Act, 1976, covers the provisions to regulate and to give legal recognition to societies in Uttar Pradesh. It lays down the procedure for society registration and operation in Uttar Pradesh. There is a prescribed procedure for society registration UP.
As per the Societies Registration (Uttar Pradesh Amendment) Act, 1976, society is an association of individuals united together with a common purpose. The common purpose would include:
A minimum of seven individuals is a prerequisite for Society Registration UP. Apart from persons from India, companies, foreigners, and other registered societies can also register as members under Society Registration. Society can be either unregistered or registered.
The UP government maintains society registration. Thus, the applicant must create an application for registering a society to the state’s specific authority, where the society office is located.
For Society registration, the members must agree with society’s name first and then prepare the Memorandum, followed by Rules & Regulations of the society.
When selecting a society’s name for registration, it is essential to note that an identical or similar name of an already registered society will not be allowed under the Society Act, 1860[1]. The proposed name shall not suggest any investment of the state government or central government of India.
Every establishing member must sign the Memorandum of Association of the society along with Rules & Regulations of society, witness by Gazetted Officer, Notary Public, Chartered Accountant, Oath Commissioner, Advocate, Magistrate first-class or Chartered Accountant with their official stamping and complete address. The Memorandum must contain the name of the society and the objects of the society. It also consists of details of members.

They are formulated for the following specific purposes:
The State Government approves the Society Registration in UP through the Registrar of Firms and Societies.
Step 1: Submit the application and the affidavit in a prescribed format along with the supporting documents to the Registrar.
Step 2: Draft a Memorandum of Association and By-Laws of the Society with signatures of at least three members on all the papers. It has to be as per the Society Registration Act guidelines and should be only for a charitable trust.
Step 3: Draft a Board Resolution where all the members had desired to form a society together with the approval of society’s name.
Step 4: Draft an affidavit at Rs.10 on Non- Judicial Paper saying that the proposed society name is not used by any other Society and the society’s address is correct.
Step 5: Now, you can proceed with the payment and finish the procedure.
The following things are essential for societies registration in UP:
Submit all the above documents to the Registrar along with the fees in 2 copies. The Registrar will give the acknowledgement and return it while keeping the second copy for approval. The Registrar will issue the Registration number after issuing an Incorporation Certificate on the documents’ proper vetting.
File the signed Rules & Regulations and Memorandum with the concerned society or Registrar of state with a mentioned fee. If satisfied with the application, they will certify that the society is registered.
