On 29th August 2022, issued a notification through the exercise of powers conferred under Section 77, 78, 79, 81, 82, 84, 85, and 87 to be read with Section 469 sub-sections (1) and (2) of the Companies Act, 2013 (18 of 2013), the Central Government of India implementing amendments to the Companies (Registration of Charges) Rules, 2014.
The notification states that these amended rules are to be referred to as the “Companies (Registration of Charges) Second Amendment Rules, 2022.” The notification further states that in the said rules, following Rule 12, the following rule is to be inserted – “13. Signing of charge e-forms by insolvency resolution professional or resolution professional or liquidator for companies under resolution or liquidation.
The MCA amends the Companies (Registration of Charges) Rules, 2014 and Form No. CHG-1, CHG-4, CHG-8 and CHG-9
