The CBIC has issued Notification No. 09\/2023-Customs (ADD) on 11th<\/sup> September 2023. The notification relates to the imposition of Anti-Dumping Duty (ADD) on import of Flat Base Steel Wheels originating in and exported from China PR for a duration of 5 years. As per this notification, the designated authority initiated a review under sub-section (5) of section 9A of the Customs Tariff Act, 1975, in conjunction rule 23 of the Customs Tariff (Identification, Assessment and Collection of Anti-Dumping Duty<\/strong><\/a> on Dumped Articles and for Determination of Injury) Rules, 1995. The review aimed to assess the continuation of the anti-dumping duty on imports of Flat Base Steel Wheels under sub-heading 8708 70 of the Customs Tariff Act, originating from China PR.<\/p>\n\n\n\n

The observations made by the designated authority are as follows:<\/p>\n\n\n\n

  1. Potential Dumping<\/strong>
    The authority concluded that the subject goods could potentially enter the Indian     market<\/a> at dumped prices if the existing anti-dumping duties were lifted.

  2. Export Price Evidence<\/strong>
    Evidence shows that the Chinese exporter were selling the goods to third countries at significantly dumped and injurious prices.
    <\/li>\n\n\n\n
  3. No Undue Advantage<\/strong>
    The Indian Industry would not gain any undue advantage from the extension of existing duties.
    <\/li>\n\n\n\n
  4. Healthy Competition<\/strong>
    The Indian market displayed healthy competition and the continuation of duties would not adversely affect user industries.<\/li>\n<\/ol>\n\n\n\n

    The CBDT<\/strong><\/a> has implemented these recommendations by exercising its power under section 9A of the Customs Tariff Act 1975 read with relevant rules. Anti-dumping duty has been imposed on “Flat Base Steel Wheels” for a period of 5 years. This decision to impose a five-year duty on imports of “Flat Base Steel Wheels” has been implemented to protect Indian Industries.
