{"id":49411,"date":"2021-04-27T12:11:54","date_gmt":"2021-04-27T06:41:54","guid":{"rendered":"https:\/\/enterslice.com\/learning\/?p=49411"},"modified":"2021-04-27T12:11:57","modified_gmt":"2021-04-27T06:41:57","slug":"mandatory-declaration-of-hsn-sac-code","status":"publish","type":"post","link":"https:\/\/enterslice.com\/learning\/mandatory-declaration-of-hsn-sac-code\/","title":{"rendered":"Mandatory declaration of HSN\/SAC Code"},"content":{"rendered":"<p class=\"has-drop-cap\">The Union Finance Minister Nirmala Sitharaman, in the 42<sup>nd<\/sup> GST council meeting held via video conferencing on 5<sup>th<\/sup> October 2020, concluded the need to disclose the HSN\/SAC codes in the GST invoice.<\/p>\n\n\n\n<p>Later, the CBIC (Central Board of Indirect Taxes and Customs) has published the HSN\/SAC code&rsquo;s mandatory declaration in the GST invoice. However, there are specific requirements, which we will look into in this article.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is the HSN\/SAC code?<\/h2>\n\n\n\n<p>HSN codestands for Harmonized System of Nomenclature. The system was introduced for the systematic classification of goods across the world. It is a 6- digit uniform code used to classify more than 5000 products worldwide. The World Customs Organization (WCO) developed the HSN and it came into effect from 1988.<\/p>\n\n\n\n<p><strong><em>The HSN system is used by many countries because:<\/em><\/strong><\/p>\n\n\n\n<ul><li>Uniform classification<\/li><li>Collection of international trade statistics<\/li><li>The base for their custom tariffs<\/li><\/ul>\n\n\n\n<p>In India, 6-digit code of HSN was initially used, later 2 more digits were added by the customs to make it 8- digit.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Structure of the HSN code<\/h2>\n\n\n\n<p>The HSN code contains 21 sections, 99 chapters, about 1244 headings &amp; 5244 subheadings.<\/p>\n\n\n\n<p>For example, 62.13.90-HSN code for Handkerchiefs. Let us understand the breakup of the HSN code.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td><strong>No.<\/strong><\/td><td><strong>Description<\/strong><\/td><\/tr><tr><td>62<\/td><td>The first 2 digits represent the no. of articles of apparel &amp; clothing accessories (not knitted or crocheted).<\/td><\/tr><tr><td>13<\/td><td>The next 2 digits represent the number of handkerchiefs.<\/td><\/tr><tr><td>90<\/td><td>The last 2 digits is the product code for handkerchiefs made for other textile materials.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p>SAC Code is the Services <a class=\"glossaryLink\"  aria-describedby=\"tt\"  data-cmtooltip=\"&lt;div class=glossaryItemTitle&gt;Accounting&lt;\/div&gt;&lt;div class=glossaryItemBody&gt;Accounting is the language of business, serving as the backbone of financial management and decision-making. It involves the systematic recording, analysis, and reporting of financial(...)&lt;\/div&gt;\"  href=\"https:\/\/enterslice.com\/learning\/terms\/accounting\/\"  data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]'>Accounting<\/a> Code developed by the CBIC (Central Board of Indirect Taxes and Customs) to classify services for better measurement, taxation &amp; recognition. SAC codes are controlled by the Central Board of Excise and Customs (CBEC).<\/p>\n\n\n\n<p>These codes are based on HSN (Harmonized System of Nomenclature), which is recognized internationally to codify all the products in the world.<\/p>\n\n\n\n<p>These codes provide a framework for the collaboration of data of sale &amp; purchase and analyze the same. The system also permits GST compliance based on international standards.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Let us now understand the SAC code<\/h2>\n\n\n\n<p>For example, 998314- SAC code for Information Technology (IT) Design &amp; Development services. Let us understand the breakup of the SAC code.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td><strong>No.<\/strong><\/td><td><strong>Description<\/strong><\/td><\/tr><tr><td>99<\/td><td>The first 2 digits are the same for all<\/td><\/tr><tr><td>83<\/td><td>The next 2 digits represent the primary nature of service, which in this case is IT services<\/td><\/tr><tr><td>14<\/td><td>The next 2 digits represent the detailed nature of services, which is a Design &amp; Development service.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">What is the need for the HSN\/SAC code?<\/h2>\n\n\n\n<p><strong><em>The HSN\/SAC codes are important as it is used to:<\/em><\/strong><\/p>\n\n\n\n<ul><li>Help the businesses and the user to identify the GST rates applicable to the goods &amp; services.<\/li><li>It is compulsory to insert the details for the registration.<\/li><li>It helps to recognize specific goods or services amid a large number of goods &amp; services.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Is there a difference between the HSN\/SAC code?<\/h2>\n\n\n\n<p><strong><em>The major difference between the two is that:<\/em><\/strong><\/p>\n\n\n\n<ul><li>HSN prescribes codes to classify goods under the GST. HSN has 8 digit code prescribed for goods only.<\/li><li>Whereas SAC has 6 digit codes prescribed to classify services under GST.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">What was the need to make mandatory disclosure of HSN\/SAC code?<\/h2>\n\n\n\n<p>The CBIC (Central Board of Indirect Taxes and Customs) has published the HSN\/SAC code&rsquo;s mandatory declaration in the <strong><a href=\"https:\/\/enterslice.com\/learning\/gst-invoice\/\">GST invoice<\/a><\/strong>.<\/p>\n\n\n\n<p>The first proviso to Rule 46 of the <strong>CGST rules, 2017<\/strong><sup><a href=\"https:\/\/www.cbic.gov.in\/resources\/\/htdocs-cbec\/gst\/cgst-act.pdf\"><strong>[1]<\/strong><\/a><\/sup>, was amended to give effect to the notification published by the CBIC. It says that the declaration of the HSN\/SAC code is mandatory in the GST invoice.<\/p>\n\n\n\n<p><strong><em>The amended proviso states that w.e.f 01-04-2021:<\/em><\/strong><\/p>\n\n\n\n<ul><li>The 4 digit HSN\/SAC code is mandatory for the B2B transactions up to Rs. 1.5 crores in the preceding financial year;<\/li><li>The 6 digit HSN\/SAC code is mandatory for the B2B transactions of more than Rs. 5 crores in the preceding financial year; and<\/li><li>The 8 digit HSN\/SAC code is mandatory for supplying chemicals in the preceding financial year.<\/li><\/ul>\n\n\n\n<p><strong><em>The following table would illuminate the current requirement of HSN\/SAC on invoice &amp; its comparison with expected change recommended by GST Council:<\/em><\/strong><\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td><strong>Current Position<\/strong><\/td><td><strong>Recommended<\/strong><\/td><\/tr><tr><td><strong>Aggregate Turnover<\/strong><\/td><td><strong>Digits<\/strong><\/td><td><strong>Aggregate Turnover<\/strong><\/td><td><strong>Digits<\/strong><\/td><\/tr><tr><td><strong>Upto Rs. 1.5 crores<\/strong><\/td><td>Not required<\/td><td><strong>Upto Rs. 5 crores<\/strong><\/td><td>4 Digits (for B2B transaction)<\/td><\/tr><tr><td><strong>More than Rs. 1.5 Cr but upto Rs. 5 Cr<\/strong><\/td><td>2 Digits<\/td><td><strong>Above Rs. 5<\/strong> <strong>crores;<\/strong><\/td><td>6 Digits<\/td><\/tr><tr><td><strong>More Than Rs. 5 Crores<\/strong><\/td><td>4 Digits<\/td><td><strong>Imports &amp; Exports of Goods<\/strong><\/td><td>8 digits<\/td><\/tr><tr><td><strong>Import Exports of Goods<\/strong><\/td><td>8 digits<\/td><td><strong>Govt notified supplies<\/strong><\/td><td>8 digits<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Penalty<\/h2>\n\n\n\n<p>According to the Section 125 of the Central Goods and Services Tax Act, 2017 a penalty of Rs. 50,000 (INR each for CGST &amp; SGST) can be imposed for non- mentioning or wrong mentioning of the HSC\/SAC code.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Conclusion<\/h2>\n\n\n\n<p>The CBIC (Central Board of Indirect Taxes and Customs) has published the HSN\/SAC code&rsquo;s mandatory declaration in the GST invoice.
