There were reports regarding constant failures on the part of the real estate developers to keep their promises, leading to long-drawn court cases and various other issues. Therefore, in order to regulate the real estate and to establish the Real Estate Regulatory Authority (RERA) for regulating and promoting the Real estate sector, the <strong>Real Estate Regulation Act, 2016<\/strong>, was enacted.<\/p>\n\n\n\n<p><strong>The main objective of this RERA Act\nis to safeguard the interest of consumers in real estate and to establish a\nredressing mechanism for a speedy resolution of the disputes<\/strong>. It led to the\nestablishment of the Appellate Tribunal to hear appeals against the decisions\nor the orders of the Real Estate Regulatory Authority. In this article, we\nshall go through the various provisions of RERA, including its registration\nprocess, documents required, offences, etc. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is RERA?<\/h2>\n\n\n\n<p>RERA stands for Real Estate Regulatory Authority. The RERA Act was enacted with an aim to regulate and promote the real estate sector so that there could be transparency and efficiency in the conduct of the sale of an apartment, land, or a building. The RERA Act, through proper regulation, ensures protection to the interest and the rights of the consumers. The Act was enforced from <strong>1<\/strong><sup><strong>st<\/strong><\/sup><strong> May 2017<\/strong>, across India after it was enacted by the Parliament in the year 2016.&nbsp; <\/p>\n\n\n\n<p>With\nits implementation, RERA would bring a high sigh of relief for the homebuyers.\nThe builders would be accountable for the promises that they make to the\nbuyers. It would ensure that consumers are protected from fraud. Proper\nregulation would encourage consumers to invest without fear.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What are the Documents Required for Registration under\nRERA?<\/h2>\n\n\n\n<p><strong>The documents which are required for registration along with the application form are listed below:<\/strong><\/p>\n\n\n\n<ol><li>The name, address and\nother particulars of the enterprise and the kind of the enterprise like\nsociety, proprietorship, companies, partnership and the photographs of the\npromoters;<\/li><li>The details of the\nprojects by the promoters in the last five years including the current status\nof the projects and details of land type and pending payments;<\/li><li>A copy of approvals and\ncommencement certificate by the authorities obtained by law;<\/li><li>The details of the\nproposed project like the sanctioned plan, layout plan and other specifications\napproved by authorities;<\/li><li>Details of the development\nwork in the proposed project;<\/li><li>The Proforma of the\n<a class=\"glossaryLink\"  aria-describedby=\"tt\"  data-cmtooltip=\"&lt;div class=glossaryItemTitle&gt;Allotment&lt;\/div&gt;&lt;div class=glossaryItemBody&gt;An allotment is the systematic distribution of business resources, often pertaining to the distribution of shares during initial public offerings (IPOs) to underwriting firms or to new and(...)&lt;\/div&gt;\"  href=\"https:\/\/enterslice.com\/learning\/terms\/allotment\/\"  data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]'>allotment<\/a> letter and agreement of sale;<\/li><li>Name and addresses of the\nagents of the real estate project, if any;<\/li><li>Information regarding the\npersons involved in the project such as engineers, architects, contractors, and\nothers;<\/li><li>A declaration stating the\nlegal title of the land on which the project is proposed by the builder\nsupported by relevant proofs;<\/li><li>In case the builder is not the owner of the land then a\nletter of consent is required from the real owner;<\/li><li>Any other relevant document is needed to be presented if\nrequired under RERA.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\">Registration Process under RERA<\/h2>\n\n\n\n<p><strong><em>The process of <\/em><\/strong><a href=\"https:\/\/enterslice.com\/rera-registration\"><strong><em>registration under RERA<\/em><\/strong><\/a><strong><em> entails the following details:<\/em><\/strong><\/p>\n\n\n\n<ul><li>Filing of the promoter details, project details including project type, project type, and other development details for uploading the same online. The full list is mentioned on the RERA website. <\/li><li>Payment of the online <strong><em><a href=\"https:\/\/enterslice.com\/learning\/rera-registration-fees-structure\/\">fees as prescribed under RERA<\/a><\/em><\/strong>.<\/li><li>Then the following copies of documents are submitted to the concerned office within three working days:<\/li><li>Application documents,<\/li><li>Receipt of the payment of fee,<\/li><li>Printout of email acknowledgement,<\/li><li>Printout of the application submission<\/li><\/ul>\n\n\n\n<div class=\"read\"><p><b>Also, Read:<\/b> <mark><a href=\"https:\/\/enterslice.com\/learning\/rera-registration-for-real-estate-agent\/\" target=\"_blank\" rel=\"noopener noreferrer\">RERA Registration for Real Estate Agent<\/a><\/mark>.<\/p><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Key highlights of RERA<\/h2>\n\n\n\n<p>RERA\ncomprises of various provisions. The <strong>important\nfeatures<\/strong> of the RERA are enumerated below.<\/p>\n\n\n\n<ul><li>The regulations of RERA\nshall be followed in the whole of India, and it shall apply to both residential\nand commercial properties.<\/li><li>Under RERA, the builders\nshall be required to deposit 70% of funds in a separate bank account collected\nfrom the consumers for the project work.<\/li><li>The developers shall be\nrequired to disclose the project details like a financial statement, legal\ntitle deed, etc. on the website, and construction progress must be updated.<\/li><li>&nbsp;A project with a minimum size of 500 sq. Metre\nor 8 apartments should be registered with RERA.<\/li><li>The builders must submit\nthe original plan of their projects and the alterations made therein to RERA.<\/li><li>Under RERA in case of\nviolation of the law, imprisonment of up to 3 years for developers and\nimprisonment of 1 year for agents and buyers.<\/li><li>If the developers or the\nbuilders of a project do not abide by the rules and regulations of RERA, they\nshall lose the registration of the project and shall also be liable for\npunishments.<\/li><li>If any structural defects\nor any workmanship defects are found in the building during the period of 5\nyears, then that must be redressed within 30 days by the promoter without any\nadditional charges. In case of failure to do so, the buyer shall receive\ncompensation under RERA.<\/li><li>The developers can&rsquo;t\ndemand beyond 10% of the <a class=\"glossaryLink\"  aria-describedby=\"tt\"  data-cmtooltip=\"&lt;div class=glossaryItemTitle&gt;Property&lt;\/div&gt;&lt;div class=glossaryItemBody&gt;Property refers to the legal designation of ownership over valuable items or assets held by an individual or a business. This ownership grants the holder certain legal rights to use, consume,(...)&lt;\/div&gt;\"  href=\"https:\/\/enterslice.com\/learning\/terms\/property\/\"  data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]'>property<\/a> cost as advanced payment before signing a\nregistered sale agreement.<\/li><li>The developers can&rsquo;t\nadvertise, offer, sell, book any plot without registering to the authority.<\/li><li>The developers shall be\nrequired to furnish an affidavit stating that the land is free from\nliabilities.<\/li><li>The complaints can be\nfiled under RERA, and it shall be followed in every state of India. It will\napply to both residential and commercial properties.<\/li><li>The sale of a property\nshall be based upon carpet area, not a super built-up area.<\/li><li>In order to protect the\ninterests of the buyer, the buyer has the right to communicate with the\ndeveloper within 1 year of taking possession to demand the shortcomings in the\nproject.<\/li><li>In case the complainant is\nnot satisfied with the decision of RERA, then the aggrieved can appeal to the\nappellate tribunal.<\/li><li>If a company commits an\noffence under the RERA Act, then the person who was leading that business at\nthe time of the offence shall be held guilty.<\/li><li>Any matter that comes\nunder the purview of RERA or the Appellate Tribunal&rsquo;s jurisdiction, no civil\ncourt shall have any jurisdiction to that matter. No court shall grant an\ninjunction against any action taken by RERA or the Appellate Tribunal.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Implications of RERA<\/h2>\n\n\n\n<p>With\nthe initiation of the RERA Act, there have been <strong>numerous positive impacts<\/strong>. Some of them are specified below:<\/p>\n\n\n\n<ul><li>Law-abiding promoters or developers shall benefit from RERA,\nconsidering that many of them shall spend time in understanding the aspects of\nthe RERA Act. It will ensure lesser competition.<\/li><li>Where the RERA Act shall benefit the Law-abiding builders and\ndevelopers, it shall ensure that dishonest builders are dealt with strictly. <\/li><li>The RERA Act shall ensure financial discipline in this\nsector.<\/li><li>This Act shall further increase the confidence of the\nconsumers to invest without any fear of being duped. Implementation of this Act\nwill make the developers adhere to go through a lot of processes in order to\nmake any change to the project. This may lead to further more investment by the\nconsumers in this sector.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">How to file a complaint under RERA?<\/h2>\n\n\n\n<p>Section\n31 of RERA allows a person to file a complaint against promoters, buyers, or\nagents. The <strong>procedure to file a complaint<\/strong>\nhas been mentioned below:<\/p>\n\n\n\n<ol><li>Fill in the complaint form\naccording to the rules of the concerned state in which the project is situated.<\/li><li>Fill the details of the\napplicant and the respondent, along with the address and registration number of\nthe project.<\/li><li>Mention facts of the case\nand the grounds for the claim, and if any relief is sought, mention the same\nalong with it.<\/li><li>Thereafter pay the\nprescribed fee. It is vital to note here that the fee may differ according to\nthe state.<\/li><li>You can also file a\ncomplaint online through your state&rsquo;s RERA website.<\/li><li>There is still a remedy\neven if you are not content with the decision of the RERA.&nbsp; You can file a complaint with the RERA\nAppellate Tribunal within 60 days of notice of such decision.<\/li><li>In case you are still not\nsatisfied with the order of the appellate tribunal, then you can challenge the\norder of the tribunal in the high court within 60 days.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\">Offences and Penalties under RERA<\/h2>\n\n\n\n<p>The\nRERA Act prescribes various penalties and punishments for offences committed\nunder it. These offences can be by promoters, buyers, or agents. The buyers experienced such problems in the past due to a lack of proper management and regulation of the <strong><a href=\"https:\/\/en.wikipedia.org\/wiki\/Real_estate\">Real estate sector<\/a><\/strong>. The main difficulties were delay in possession of the properties, poor quality projects, lack of accountability from the developers or the builders.
