The amendments were brought about by the central\ngovernment. It amended the motor vehicle act of 1988. On September 1, 2019, the\nmotor vehicle <a class=\"glossaryLink\"  aria-describedby=\"tt\"  data-cmtooltip=\"&lt;div class=glossaryItemTitle&gt;Amendment&lt;\/div&gt;&lt;div class=glossaryItemBody&gt;An &amp;quot;amendment&amp;quot; refers to the formal change or correction of a legal document, often involving additions, variations, or deletions to address irregularities or clarify points in an agreement.(...)&lt;\/div&gt;\"  href=\"https:\/\/enterslice.com\/learning\/terms\/amendment\/\"  data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]'>amendment<\/a> act 2019 was implemented across the country, thereby\nincreasing the penalty for the violations up to ten times than before. In this\narticle, we shall go through the amendments brought in the new motor vehicle\nAct 2019.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Motor Vehicle Act Of 1988<\/h2>\n\n\n\n<p>The\nMotor Vehicle Act of 1988 was passed by the Parliament of India in the year\n1988, and it covered everything with respect to the road transport vehicle.\nThis act came into force on 1<sup>st<\/sup> July 1989. It contained provisions\non traffic regulation, liabilities, penalties etc. which has now been amended\nby the New Motor Vehicle Act 2019.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Why Were Amendments Made In Motor Vehicle Act?<\/h3>\n\n\n\n<p>According\nto the reports provided by the WHO (World Health Organisation) in the year\n2018, the highest number of road accidents takes place in India. Thus, making\nthe Indian roads unsafe to tread upon.&nbsp;\nThe Indian government, in order to prevent the casualties, amended the\nerstwhile Motor Vehicle Act 1988. The law was put in place to ensure safe,\nefficient and corruption-free transport system in the world. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What Does The New Motor Vehicle Act Contain?<\/h3>\n\n\n\n<p>The\nnew Motor Vehicle Act brought in sweeping changes wherein the penalties were\nenhanced massively.<\/p>\n\n\n\n<p>It\nhas enhanced fines for drunk driving, driving without a licence, over speeding\netc. The new motor vehicle laws also protect those who render medical or non-\nmedical help to accident victims from criminal or civil liability. Many new sections have been added, and\nheavy penalties have been imposed upon violations of the road safety standards.\n<\/p>\n\n\n\n<div class=\"read\"><p><b>Also, Read:<\/b> <mark><a href=\"https:\/\/enterslice.com\/learning\/section-44ae-of-the-income-tax-act-1961\/\" target=\"_blank\" rel=\"noopener noreferrer\">Section 44AE of the Income Tax Act, 1961: Presumptive Taxation Scheme<\/a><\/mark>.<\/p><\/div>\n\n\n\n<h3 class=\"wp-block-heading\">What Else?<\/h3>\n\n\n\n<p>Apart\nfrom these, the new motor vehicle act raised the compensation scheme under the\nhit and run cases. In case of death, compensation shall be provided of Rs 25000\nto two lakh rupees and in case of grievous injury, compensation of Rs 12000 to\n50000 Rs.<\/p>\n\n\n\n<p>Under\nthe new motor vehicle act, the central government is empowered to order for\nrecall of defected vehicle, which can be hazardous to the safe environment or\nfor the road users.<\/p>\n\n\n\n<p>The\nact directs the central government for the creation of Road Safety Board which\nwill advise the central as well as the state government on road safety and\ntraffic management.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Why Have The Punishments\/Fines For The Offences Raised Remarkably?<\/h3>\n\n\n\n<p>According\nto the various reports put forward by different institutions over time, the\nreports suggest a spike in the number of road accidents in India.&nbsp; India ranked number 1 in the number of deaths\ncaused by road accidents among the 199 countries in 2018, <a class=\"glossaryLink\"  aria-describedby=\"tt\"  data-cmtooltip=\"&lt;div class=glossaryItemTitle&gt;Accounting&lt;\/div&gt;&lt;div class=glossaryItemBody&gt;Accounting is the language of business, serving as the backbone of financial management and decision-making. It involves the systematic recording, analysis, and reporting of financial(...)&lt;\/div&gt;\"  href=\"https:\/\/enterslice.com\/learning\/terms\/accounting\/\"  data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]'>accounting<\/a> for almost\n11 % of road accident-related deaths.<\/p>\n\n\n\n<p>The transport Minister <strong><em><a href=\"https:\/\/twitter.com\/nitin_gadkari\">Nitin Gadkari<\/a><\/em><\/strong> confessed in the parliament that the ministry had failed terribly in reducing the number of deaths caused due to road accidents. Therefore the amendment was essential as it would act as a future deterrent.<\/p>\n\n\n\n<p>The Motor vehicle amendment Act 2019 was brought in to improve the road safety in India and to upgrade the laws on-road standards. One of the fundamental objectives of the new motor vehicle act is to ensure an efficient, safe and corruption less transport system in the country.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Takeaway<\/h4>\n\n\n\n<p>The\namendment to the Motor Vehicle Act has been a pro-active move on the part of\nthe government to ensure safety on the roads which in recent times have been\ntermed as killer roads. The provisions of the new motor vehicle act shall\nhopefully prove to be a deterrent for many and shall cause a reduction in the\nnumber of road accidents in India.
