The meeting covered a wide range of issues such as measures for encouraging voluntary compliance, expanding the tax base, measures to improve return filing and tax collection and rate rationalization etc. Before concluding the meeting, the GST council also considered the presentation made by the committee of officers of State and Centre on revenue augmentation. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Key Highlights of 38th GST council Meeting<\/h2>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" loading=\"lazy\" width=\"591\" height=\"340\" src=\"https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/12\/image.png\" alt=\"38th GST Council Meeting\" class=\"wp-image-27522\" srcset=\"https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/12\/image.png 591w, https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/12\/image-300x173.png 300w\" sizes=\"(max-width: 591px) 100vw, 591px\"\/><figcaption>38th GST Council Meeting<\/figcaption><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">The detailed explanation of the outcomes of the GST Council Meeting:<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Formation of Grievance Redressal Committees (GRC)<\/h3>\n\n\n\n<p>Grievance Redressal\nCommittees (GRC) shall be commissioned at Zonal\/ State level to address\ngrievances of taxpayers at the Zonal\/State level. The committee will include\nboth CGST and SGST officers along with the representatives of trade and\nindustry and other GST stakeholders.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">GSTR-9 and GSTR-9C due date extended<\/h3>\n\n\n\n<p>The due date for annual return in <a href=\"https:\/\/enterslice.com\/learning\/gstr-9-annual-return-filing-form\/\">GSTR-9<\/a> and reconciliation statement in GSTR-9C has been extended to 31st January 2020 for FY 2017-18. Earlier the last date was 31st December 2019. This extension of the due date will give taxpayers some more time to use the offline tool of GSTR-9C, which is expected to be made available on 21st December 2019.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Late Fee Waiver on GSTR 1<\/h3>\n\n\n\n<p>A waiver of the late fee will be given if GSTR1 for tax period between July 2017 to November 2019 is filed by 10th January 2020. If a taxpayer does not file their <a href=\"https:\/\/enterslice.com\/learning\/gstr-1-return\/\">GSTR-1<\/a> for two tax periods, E-way bill generation for such taxpayers shall be blocked.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">ITC claim restricted to 10%<\/h3>\n\n\n\n<p>GST council has\ndecided to restrict the provisional Input Tax Credit (ITC) availed by a\ntaxpayer to 10% if invoices or debit notes are not reflected in GSTR-2A. Before\nthe GST Council Meeting, the restriction was set to 20%.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">GST Returns due date extended for certain taxpayers<\/h3>\n\n\n\n<p>The last date of <a href=\"https:\/\/enterslice.com\/gst-return-filing\">filing GST returns<\/a> for the month of November 2019 has been extended for few North- Eastern States.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Standard Operating Procedure for tax officers<\/h3>\n\n\n\n<p>GST Council decided to issue a Standard Operating Procedure for tax officers. This shall help the tax officers to take action in cases of non-filing of <a href=\"https:\/\/enterslice.com\/learning\/gstr-3b-initial-gst-return-filing\/\">GSTR 3B returns<\/a>.<\/p>\n\n\n\n<p>The GST Council\napproved various laws and amendments in the meeting which shall be introduced\nin Budget 2020.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Revised\nGST Rates after 38th GST Council Meeting<\/h2>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td>\n  <strong>Types<\/strong>\n  <\/td><td>\n  <strong>Exemptions\/Present Rates <\/strong>\n  <\/td><td>\n  <strong>Exemptions\/ Proposed Rates<\/strong>\n  <\/td><td>\n  <strong>with effect from (W.e.f)<\/strong>\n  <\/td><\/tr><tr><td>\n  Long term lease of industrial\/ financial infrastructure\n  <\/td><td>\n  The Exemption is available on the upfront amount payable by an entity\n  having <strong>50%<\/strong>\n  or more ownership of Central or State Government\n  <\/td><td>\n  The Exemption will be available on the upfront amount payable by an\n  entity having <strong>20% <\/strong>or&nbsp; more ownership of Central or\n  State Government\n  <\/td><td>\n  This change in exemption shall become effective from 1<sup>st<\/sup>\n  January, 2020\n  <\/td><\/tr><tr><td>\n  State run and State authorized lottery\n  <\/td><td>\n  State run- 12%\n  State- authorized- 28%\n  <\/td><td>\n  Uniform Lottery rate for \n  for all states i.e. 28%\n  <\/td><td>\n  This change in GST rste shall be effective from 1<sup>st<\/sup> March,\n  2020\n  <\/td><\/tr><tr><td>\n  Woven and Non-Woven Bags and sacks of polyethylene or polypropylene\n  strips used for packing of goods and Flexible Intermediate Bulk Containers\n  (FIBC)\n  <\/td><td>\n  Present GST Rate is 12%\n  <\/td><td>\n  Proposed GST Rate is 18%\n  <\/td><td>\n  This change shall be effective from 1<sup>st<\/sup> January, 2020.\n  <\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Take Away<\/h2>\n\n\n\n<p>The 38th GST Council\nMeeting took place in a time when there is a considerable pressure on the\ncouncil to boost revenues amidst a shortfall. However, the council decided not\nto tamper the GST rates. Increasing the GST rates may lead to inflation and\nprompt people to spend less.<\/p>\n\n\n\n<p>The <strong>GST Council<\/strong><sup><a href=\"http:\/\/www.gstcouncil.gov.in\/\"><strong>[1]<\/strong><\/a><\/sup> for the first time in its history of 38 meetings decided to depart from its regular consensus-based decision making and opted for voting to determine the taxation of lotteries.
