It is evident from the fact that every company is now creating its own strong Patent portfolio. Now it is important for every company to know the advantages involved in getting a Patent and also how does the Patent benefit an Inventor. The objective of this is to develop a greater awareness about the Patent law in India and to know properly the procedural mechanism involved in obtaining a <a href=\"https:\/\/enterslice.com\/patent-registration\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"Patent Registration In India (opens in a new tab)\">Patent Registration In India<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Governance of Patent Registration in India<\/h2>\n\n\n\n<p>The Patents are granted by\nthe Controller to the Inventor(s) for a period of 20 years. Patents provide exclusive\nright to make use the exercise of his invention. The Act provides exclusive\nrights to the Inventor and also provides him the valuable monetary right which\nhe can use for his own advantage either by using it himself or by conveying the\nprivileges to others. Patentee receives something tangible, something which has\na present existing value which protects him from some competition and is a\nsource of gain and profit.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is Patent?<\/h2>\n\n\n\n<p>A Patent is a new invention by an Inventor or a group of Inventors. It is a form of a document. A Patent gives to the Inventor or the application exclusive right to sell, manufacture and use the invention disclosed in the Patent. The Patent right can be exercised and enjoyed by the Inventor\/applicant only in the country which grants him the right and that too for a limited period of time, normally known as the &lsquo;Term of the Patent&rsquo;. An invention can be a product (chemical\ncompound) or a process, like producing a specific chemical compound. A single product\nin fact, contains number of inventions. For example, the computer involves\nhundreds of inventions, working together. <\/p>\n\n\n\n<ul><li>There are certain criteria that are required prior to <a rel=\"noreferrer noopener\" aria-label=\"Patent Protection (opens in a new tab)\" href=\"https:\/\/enterslice.com\/patent-registration\" target=\"_blank\">Patent Protection<\/a><\/li><li>Element of novelty must be there in the invention.<\/li><li>The invention must involve number of inventive steps.<\/li><li>It must be capable of industrial application i.e. It is capable of being made or used in an industry<\/li><li>The subject matter must be accepted as &ldquo;patent-able &ldquo;under law.<\/li><li>An application of the invention must be properly disclosed in a manner specified under the law.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Who can avail the Patent Registration?<\/h2>\n\n\n\n<p>An application for <a href=\"https:\/\/enterslice.com\/patent-registration\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"patent registration (opens in a new tab)\">patent registration<\/a> can be filed by the inventor or his assignee.<\/p>\n\n\n\n<p><\/p><div class=\"shadow2\"><strong>Exception &ndash; <\/strong>Legal representative of any deceased person can make an application for patent.<\/div>\n\n\n\n<p>An application for patent\nlicense can be filed with Indian Patent Office either with specification (Provisional\nor complete) along with fee mentioned in schedule I. In case of provisional\nspecification, a person has to file complete specification within 12 months\nfrom the date of filing of the provisional application. <\/p>\n\n\n\n<p><\/p><div class=\"shadow2\"><strong>Note &ndash; <\/strong>No further extension of time to\nfile complete specification after expiry of said period.i.e.12 months<\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Who can grant Patent License?<\/h2>\n\n\n\n<p>A Patent license is\ngranted by a National Patent Office or by a regional office which carries out a\ntask for a number of countries.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Criteria for registering an Online Patent Application<\/h2>\n\n\n\n<ul><li>Must obtain the class III Digital Signature from the certifying authorities<\/li><li>The user can register himself on the <strong>CGPDTM Website<\/strong>.<sup><a href=\"http:\/\/www.ipindia.nic.in\/\">[1]<\/a><\/sup><\/li><li>Create a user Id and password.<\/li><\/ul>\n\n\n\n<p><\/p><div class=\"shadow2\"><strong>Note &ndash; <\/strong>An application can only be filed either in Hindi or English.<\/div>\n\n\n\n<h2 class=\"wp-block-heading\">When Patent Application is published?<\/h2>\n\n\n\n<p>The application for <strong>patent registration<\/strong> is published after the expiry of 18 months from the date of filing or priority date whichever is earlier. <\/p>\n\n\n\n<p><strong>Exceptions &ndash;<\/strong><\/p>\n\n\n\n<ol><li>Application in which secrecy direction is imposed <\/li><li>As per section\n9(1)Application which has been abandoned i.e. when a provisional application\nhas been filed and the complete application has not been filed with 12 months\nfrom the filing of the provisional application <\/li><li>The Application\nwhich has been withdrawn 3 months prior to 18 months.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\">What are the modes of payment for an applicant to pay the fees for Patent Registration?<\/h2>\n\n\n\n<p>An applicant can pay the\nfees either-<\/p>\n\n\n\n<ul><li>In cash at the cash counter.<\/li><li>Online through payment gateway including\nnet banking, or through Debit or Credit card.<\/li><\/ul>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter is-resized\"><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/07\/Payment-patent-registration.png\" alt=\"Patent Registration\" class=\"wp-image-21576\" width=\"304\" height=\"305\" srcset=\"https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/07\/Payment-patent-registration.png 451w, https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/07\/Payment-patent-registration-150x150.png 150w, https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/07\/Payment-patent-registration-300x300.png 300w\" sizes=\"(max-width: 304px) 100vw, 304px\"\/><\/figure><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Conclusion<\/h2>\n\n\n\n<p>With an objective of strengthening its patent law, India became a signatory to many international arrangements and additionally also coming in league with the modern world. India became a member of the Trade Related Intellectual Property Rights (TRIPS) system which was one of the significant steps towards achieving this objective. <\/p>\n\n\n\n<p>Therefore, securing a Patent ultimately brings in Wealth and Prosperity. In reality, securing a Patent may lead to success if one is able to commercially use the invention. The only objective of granting a Patent is to encourage inventive activities in a practical term and is revised from time to time depending upon the political, socio-economic and industrial environment.
