We are going to know about this in detail in this blog. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is a Petty Food Business?\nIntroduction on Petty Food Business<\/h2>\n\n\n\n<p>Petty food businesses are the type of business or a person who manufacturers or sells their products themselves. Small food business operators who have a turnover of less than Rs.12 lakhs per annum come under this category of food business. This type of food business is very popular and a major source of a variety of foods in India.&nbsp; There are several types of petty food businesses. These are namely,<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Manufacturers<\/h3>\n\n\n\n<ul><li>Dairy units including the chilling units involved in handling or\nprocessing: Units managing up to 500 liters of milk per day or producing 2.5\nmetric ton of milk solids per year.<\/li><li>Vegetable oil processing units and Units producing vegetable oil\nby using the method of solvent extraction and refineries including oil expelled\nunits. All these units having a turnover up to Rs. 12 lakhs is only eligible.<\/li><li>Meat processing units having a turnover up to Rs.&nbsp; 12 lakhs.<\/li><li>Units including re-labelers and re-packers: whose turnover is up\nto Rs. 12 lakhs and deals with a food capacity of 100 kg or 100 liters <\/li><li>Slaughtering units who deal with 10 small animals, 50 poultry birds\nand 2 large animals per day<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Storage Units<\/h3><br>\n\n\n\n<ul><li>Storage units except for the Controlled atmosphere units and cold\nhaving turnover not exceeding Rs. 12 lakhs.<\/li><li>Cold\/refrigerated units : whose turnover is up to Rs. 12 lakhs<\/li><li>Controlled atmosphere units : whose turnover is up to Rs. 12 lakhs<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Other Businesses <\/h3><br>\n\n\n\n<ul><li>Wholesalers<\/li><li>Retailers<\/li><li>Distributors<\/li><li>Suppliers<\/li><li>Clubs and canteens<\/li><li>Hotels<\/li><li>Restaurants<\/li><li>Transporters<\/li><li>Marketers<\/li><li>Hawkers or mobile food vendors<\/li><li>Petty retailers of snacks and tea stalls<\/li><li>Dhaba, boarding houses, Banquet halls, home based canteens, dabbawalas, permanent and temporary stall holders, food stalls, Religious or social gatherings who distribute food and other food vending establishments<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Why do you need a Food License?<\/h2>\n\n\n\n<p>People or entities who wish to start their businesses in food sector have to obtain FSSAI License in order to carry any food related business. Entities need FSSAI License depending upon the eligibility and the type of business they wish to run. Without license any food business is not allowed to run. The Food Safety and Standard Authority issue a license under <strong>FSS Act<\/strong><sup><a href=\"https:\/\/www.indiacode.nic.in\/bitstream\/123456789\/7800\/1\/200634_food_safety_and_standards_act%2C_2006.pdf\"><strong>[1]<\/strong><\/a><\/sup> which is mandatory for all businesses to print that number on the packaging. Above we saw that there are two types of FSSAI Registration, and there are two types of FSSAI License. The documents that need to be submitted by these types of FBOs are:<\/p>\n\n\n\n<ul><li>Photo ID of the owner<\/li><li>Rent agreement\/ utility bill<\/li><li>Partnership deed<\/li><li>List of food products that are manufactured <\/li><li>Form B signed and completed<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">How to get FSSAI License<\/h2>\n\n\n\n<p>Here given\nare the steps to obtain the FSSAI License by the food business owners:<\/p>\n\n\n\n<ul><li>First the applicant has to submit Form A to Food &amp; Safety\ndepartment.<\/li><li>The Food &amp; Safety department may accept or reject the\napplication. The department also intimates the applicant in written. This\nprocess takes seven days.<\/li><li>The Food &amp; Safety department issues a registration certificate\nif the application is accepted.<\/li><li>After the completion of these steps the applicant receives the\nlicense.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Exemptions of food license<\/h2>\n\n\n\n<p>There are certain FBOs who do not need to obtain FSSAI Registration. Furthermore, Petty retailers are exempted from obtaining the FSSAI registration\/license. Apart from this following FBOs are exempted:<\/p>\n\n\n\n<ul><li>Itinerant vendors<\/li><li>Small-scale FBOs<\/li><li>Cottage food seller<\/li><li>Tiny food business operators<\/li><li>Temporary stallholders <\/li><li>Hawkers<\/li><li>Other food businesses with a turnover less than 12 lakhs<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Penalty for the violation of FSS Act <\/h2>\n\n\n\n<p>The FSS Act has set guidelines and every running food business needs to follow those rules. Hence, food business operator contravenes to these laws or else they, are bound to punishment. There can be cases where an FBO can be eligible for penalty.<\/p>\n\n\n\n<p><strong>Penalty for running a food business without license: <\/strong>Every food\nbusiness operator has to have a license to carry out their business. The\npenalty on failing to so be imprisonment up to six months and fine up to five\nlakhs.&nbsp; <\/p>\n\n\n\n<p><strong>Fine for selling food not under the prescribed quality\/substance\/\nnature etc<\/strong>.:\nFood businesses needs who sell foods not meeting the prescribed\nquality\/substance\/ nature under the FSS Act are liable to a fine not more than\nRs. Five lakhs and the fine for the exempted category is up to Rs. Twenty five\nthousand.<\/p>\n\n\n\n<p><strong>Punishment for sub-standard food:<\/strong> The penalty\nfor the selling of substandard article of food can extend to Rs. five lakhs.<\/p>\n\n\n\n<p><strong>Penance for misbranded food: <\/strong>Any food operator who sells food\nby misbranding it in any means is liable for fine up to three lakh rupees.<\/p>\n\n\n\n<p><strong>Fine for selling food containing extraneous matter<\/strong>: A person,\nwho sells, stores, distributes or imports food items containing extraneous\nmatter have to pay a fine up to one lakh rupees.<\/p>\n\n\n\n<p><strong>Punishment for manufacturing or processing food in unhygienic conditions: <\/strong>An FBO who manufactures or processes food in unhygienic \/ unsanitary conditions is liable for a fine up to one lakh rupees.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter is-resized\"><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/06\/Food-Business-Penalty.jpg\" alt=\"Food Business Penalty\" class=\"wp-image-20747\" width=\"464\" height=\"360\" srcset=\"https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/06\/Food-Business-Penalty.jpg 626w, https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/06\/Food-Business-Penalty-300x233.jpg 300w\" sizes=\"(max-width: 464px) 100vw, 464px\"\/><\/figure><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Disclaimer<\/h2>\n\n\n\n<p>The Indian\nGovernment has made rules under the FSS Act, which keeps track and ensures all\nthe food businesses in India are registered irrespective of their size. It\nissues licenses to these businesses to ensure that the food product they are\nmanufacturing or selling is fit for human consumption. Also, it ensures that\nthe food is manufactured in a clean environment and the process of distribution\nis clean.<\/p>\n\n\n\n<p>FSSAI Registration is mandatory for all types of FBOs which are in running condition, including the petty food businesses.
