It indicates the creation of human minds that can be in any form like-Invention, Artistic Work, Literary work, Symbols and Design. As the name suggests it\ngives the author an exclusive right to stop others from copying the literature\nproduced by him. Copyright not only covers and protects (Literary, dramatic,\nmusical and artistic works) but also protects the copying of sound recordings,\nfilms,typographical arrangements of publications and cable programs.<\/p>\n\n\n\n<p>Copyright means to enjoy the exclusive right given to do or authorize the doing of the following act &ndash; <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Literary Work, Dramatic and Musical Work and Artistic Work<\/strong><\/h3>\n\n\n\n<p>Reproducing the work in any material form, issuing copies of\nwork to the public which are not in circulation, performing the work in public\nand also communicating it and cinematographic making.<\/p>\n\n\n\n<p>It also includes translation and adaption of the same work.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Computer\nProgramme<\/strong><\/h3>\n\n\n\n<p>To perform or do such acts specified in respect of literary, dramatic and musical work, or to sell computer program or give on commercial rental. Note-Commercial rental does not apply in respect of computer programmes where the computer programme is not the essential object of rental. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Cinematograph Films and Sound Recording<\/strong><\/h3>\n\n\n\n<p>Making a copy of the film, selling or giving on\nhire,communicating the film\/sound recording to the public.<\/p>\n\n\n\n<p>To sell or give on hire or offer for sale any copy of sale recording.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Types of licenses under Copyright Registration?<\/strong><\/h2>\n\n\n\n<p>There are two types of license under <a href=\"https:\/\/enterslice.com\/copyright-registration\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"copyright registration (opens in a new tab)\">copyright registration<\/a><strong>&ndash;<\/strong><\/p>\n\n\n\n<ul><li><strong>Exclusive Right<\/strong><\/li><\/ul>\n\n\n\n<p>Exclusive right is a right with a single owner. It represents the expression which is original or creativity of the author in the content \/class of work. Originality does not require novelty but an independent creation.Copyright protection is given when the work is original and creative.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What is Creative Expression?<\/strong><\/h2>\n\n\n\n<p>Copyright protection is only provided when there is some aspect of creativity. The expression of the work requires to be original. As per the Act the originality is a minimum amount of originality. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What is\nTangible Medium?<\/strong><\/h2>\n\n\n\n<p>For creative expression,the medium must be tangible. The work must be recorded in a Tangible format. For receiving copyright protection, the work done must be recorded in the Tangible format. Prior to the recording if the work expression is communicated in the public domain, it may find itself being incapable of copyright protection. The Tangible medium must be fixed to perceived,reproduced for more than a transitory period. It must meet the <strong>PRC requirement<\/strong> (Perceived, Reproduced, communicated in a medium. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Example of PRC Requirement &ndash;<\/strong><\/h3>\n\n\n\n<ul><li><strong>Perceived &ndash; <\/strong>A song written on paper because it may be apprehend.<\/li><\/ul>\n\n\n\n<ul><li><strong>Reproduced <\/strong>&ndash; To reproduce the same photo, a photograph is keep on Computer&rsquo;s hard drive.<\/li><\/ul>\n\n\n\n<ul><li><strong>Communicated <\/strong>&ndash; A speech on a paper or cassette tape because the speech may be communicated<strong>.<\/strong><\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What are Protected Elements in Literary and Visual Works?<\/strong><\/h2>\n\n\n\n<p>The boundaries are uncertain which separates ideas and expression variation based on the type of work involved. Literary and visual works have protected elements i.e.<\/p>\n\n\n\n<ul><li><strong>Literary Work &ndash; <\/strong>In literary work protected elements include <ul><li>Uniquely developed Character.<\/li><li>Sequences of events in the storyline<\/li><\/ul><\/li><\/ul>\n\n\n\n<ul><li><strong>Visual work<\/strong>-The elements that necessarily flow from the subject matter are out of the preview of protected elements of Visual Works.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What are the Rights that the Copyright Holder Carries?<\/strong><\/h2>\n\n\n\n<p>The Copyright holder carries various rights which include-<\/p>\n\n\n\n<ul><li>Reproducing the work,<\/li><li>Derivative work,<\/li><li>Performing the work Publicly,<\/li><li>Distributing the work Publicly,<\/li><li>Publicly display the work,<\/li><li>Performing sound recordings by\ndigital audio transmission publicly.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Is it mandatory to get Copyright Registration?<\/strong><\/h2>\n\n\n\n<p><a href=\"https:\/\/enterslice.com\/copyright-registration\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"Copyright registration (opens in a new tab)\">Copyright registration<\/a> is not mandatory, but to the seek legal remedy from the court as it acts as a prima facie evidence.
