Mr Ramesh Abhishek, secretary of &ldquo;<strong>Department for Promotion of Industry and Internal Trade (DPIIT)<\/strong>&rdquo; said this on 27<sup>th<\/sup> May 2019. Before this, the Board of direct taxes (CBDT) came up with the exemptions for startups in February. Only 36 applications didn&rsquo;t get the advantage of this exemption due to improper documentation. <\/p>\n\n\n\n<p>\n\nNow, let&rsquo;s get down to it; \n\n<\/p>\n\n\n\n<br><div class=\"shadow1\"><strong>&ldquo;All the startups are allowed to receive angel tax exemption regardless of their share premium values given that the aggregate amount of paid-up share capital and share premium of the startup after issue or proposed issue of shares, if any, does not exceed, Rs 25 crore.&rdquo;<\/strong><\/div><br>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What is Angel Tax?<\/strong><\/h2>\n\n\n\n<p>Angel tax was first introduced by finance minister Pranab Mukherjee in the budget of the year 2012-2013 to curb money laundering practices. It is applicable to startups which receive equity infusion in excess of the fair valuation, with the premium being paid by the investors as income.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter is-resized\"><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/05\/Angle-Tax-1.jpg\" alt=\"Angel Tax Exemption\" class=\"wp-image-17863\" width=\"374\" height=\"374\" srcset=\"https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/05\/Angle-Tax-1.jpg 626w, https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/05\/Angle-Tax-1-150x150.jpg 150w, https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/05\/Angle-Tax-1-300x300.jpg 300w\" sizes=\"(max-width: 374px) 100vw, 374px\"\/><\/figure><\/div>\n\n\n<h2 class=\"wp-block-heading\"><strong>Why\nthis Update Came?<\/strong><\/h2>\n\n\n\n<p>In February, the government came with the notification as per which changes were notified under section 56 (2) (vii)(b) of the Income Tax Act, 1961. As per this section, in case a privately held company issues shares at a price higher than the fair <a class=\"glossaryLink\"  aria-describedby=\"tt\"  data-cmtooltip=\"&lt;div class=glossaryItemTitle&gt;Market&lt;\/div&gt;&lt;div class=glossaryItemBody&gt;A market is a structured environment, either physical or virtual, where buyers and sellers convene to trade goods and services. While immediately after this, DPIIT (Department for Promotion of Industry and Internal Trade) came with the angel tax exemption for 541 startups. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>The Tweet made by the DPIIT Secretary <\/strong><\/h3>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" loading=\"lazy\" width=\"609\" height=\"287\" src=\"https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/05\/DPIIT-Secretary-Tweet-1.png\" alt=\"Angel Tax Exemption\" class=\"wp-image-17869\" srcset=\"https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/05\/DPIIT-Secretary-Tweet-1.png 609w, https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/05\/DPIIT-Secretary-Tweet-1-300x141.png 300w\" sizes=\"(max-width: 609px) 100vw, 609px\"\/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Highlights\nof the Update<\/strong><\/h2>\n\n\n\n<ul>\n<li>To address deficiencies, <a href=\"https:\/\/enterslice.com\/learning\/startup-india-registration-process-the-complete-guide\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"startup India (opens in a new tab)\">startup India<\/a> team is working with 36 startups;<\/li>\n\n\n\n<li>CBDT and DPIIT worked together on this;<\/li>\n\n\n\n<li>In February 2019, <a rel=\"noreferrer noopener\" aria-label=\"DPIIT (opens in a new tab)\" href=\"https:\/\/dipp.gov.in\/\" target=\"_blank\">DPIIT<\/a> granted angel tax exemption.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>CBDT\nClarification on Procedure <\/strong><\/h2>\n\n\n\n<p>CBDT clarified on those startups which have already received assessment notices as per section 56 (2) (vii) (b) of the Income Tax Act, 1961 will get angel tax exemption if they comply with the notification arrived this year in February 2019. <\/p>\n\n\n\n<p>In the last month of April, the government was in the frame of mind to grant angel tax relief\/exemptions to startups which have raised funds from accredited investors, subject to complying with the net worth criteria. With a view to increasing investment flow in startups, this provision was considered by the government to describe accredited investors. <\/p>\n\n\n\n<p><strong>As per the government official;<\/strong><\/p>\n\n\n\n<div class=\"shadow1\"><strong>&ldquo;Accredited or genuine investors can invest any amount but we will make some criteria for that. It should be liberal enough so that all such people can come under its purview. But it should not be over liberal and extra-stringent.&rdquo;<\/strong><\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Previous\nScenario <\/strong><\/h2>\n\n\n\n<p>In the year 2012, provisions of angel tax were first introduced under Section 56(2)(viib) of the Income Tax Act in order to test illegal transactions. But later on, it entirely focused on startups that raised funds. Earlier, a huge number of startups were penalized in terms of the provision of angel tax under Section 56(2)(viib) of the Income Tax Act, 1961. <\/p>\n\n\n\n<p>Startup Sector was demanding angel tax exemption from the government. While the investors &amp; entrepreneurs were continuously looking for its abolition. However, the government is not planning to go this far. <\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter is-resized\"><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/05\/Startup.jpg\" alt=\"Angel Tax Exemption\" class=\"wp-image-17864\" width=\"373\" height=\"248\" srcset=\"https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/05\/Startup.jpg 626w, https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/05\/Startup-300x200.jpg 300w\" sizes=\"(max-width: 373px) 100vw, 373px\"\/><\/figure><\/div>\n\n\n<p>Startups which have raised capital up to Rs 25 crore can claim the tax benefit; earlier, this limit was up to Rs. 10 Crore.<\/p>\n\n\n\n<p>In this regard, exemptions have been allowed for investments made by non-resident Indians and <a aria-label=\"alternative investment funds (AIFs) (opens in a new tab)\" href=\"https:\/\/enterslice.com\/alternative-investment-fund-registration\" target=\"_blank\" rel=\"noreferrer noopener\">alternative investment funds (AIFs)<\/a> and for capital infusion into start-ups in the form of an equity stake in a listed company.<\/p>\n\n\n\n<p><strong>For better clarification, let&rsquo;s understand the Startup; <\/strong><\/p>\n\n\n\n<p>An entity is considered a startup for the next 10 years from the date of its incorporation, while earlier, the limit was 7 years. This had been done to avail tax benefits for a longer period. <\/p>\n\n\n\n<p>Besides this, now entity with a turnover of up to Rs. 100 crore is also termed as startup; earlier, the limit was 25 crore. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Takeaway\n<\/strong><\/h2>\n\n\n\n<p>Startups have to register with the DPIIT to avail of the tax exemption benefit. For this, they have to submit an undertaking claiming that they are not making investments in money laundering practices unless made in the ordinary course of business.
