India has a policy for non-residents which encourage them\nto invest in this sector. In the year 2005, Reserve Bank of India (RBI) issued\na notification and the township, housing, construction development project\nsector and built up infrastructure was opened for 100% FDI with specific terms\nand conditions.<\/p>\n\n\n\n<p>The Foreign Direct Investment (FDI) route has involved overseas investor&rsquo;s interest in this sector because of the ban on the infusion of funds into this sector by any other modes. Moreover, using External Commercial Borrowings (ECBs) and Foreign Currency Convertible Bonds (FCCBs) to raise finances for investment into real estate has been completely barred. Earlier, only Non-Resident Indians (NRIs) and Persons of Indian\nOrigin (PIOs) were allowable to invest in the real estate sector and the housing\nprojects. <\/li><li>Foreign investors, other than NRIs, were permitted to invest only\nin the development of integrated townships and settlements, either through a\nwholly owned subsidiary or a joint venture company in India, with a local\npartner. <\/li><li>However, the guidelines prescribed via Press Note 2 (2005) series,\nissued by Ministry of Commerce &amp; Industry, have further open out FDI in\ntownships, housing, built-up infrastructure and construction-development\nprojects. <\/li><li>Hence, Major corporations are taking the scheme and are wooing global\nplayers for investments in important projects.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Basic Guidelines for FDI in Real Estate in India<\/strong><\/h2>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" loading=\"lazy\" width=\"890\" height=\"432\" src=\"https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/05\/image-42.png\" alt=\"Basic Guidelines\" class=\"wp-image-16944\" srcset=\"https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/05\/image-42.png 890w, https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/05\/image-42-300x146.png 300w, https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/05\/image-42-768x373.png 768w\" sizes=\"(max-width: 890px) 100vw, 890px\"\/><\/figure>\n\n\n\n<p>Currently,\n100% FDI is allowable through automatic route for any construction development\nproject which would include:<\/p>\n\n\n\n<ul><li>development of townships,<\/li><li>construction of residential\/commercial premises, <\/li><li>roads or bridges,<\/li><li>hotels,<\/li><li>resorts, <\/li><li>hospitals, <\/li><li>educational institutions,<\/li><li>recreational facilities, <\/li><li>city and regional level infrastructure and townships<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>FDI in Real Estate in India<\/strong><\/h2>\n\n\n\n<p>We can study FDI in Real Estate sector into two parts:<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter\"><img decoding=\"async\" loading=\"lazy\" width=\"583\" height=\"340\" src=\"https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/05\/image-36.png\" alt=\"FDI in Real Estate\" class=\"wp-image-16901\" srcset=\"https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/05\/image-36.png 583w, https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/05\/image-36-300x175.png 300w\" sizes=\"(max-width: 583px) 100vw, 583px\"\/><\/figure><\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Permitted: <\/strong><\/h2>\n\n\n\n<p>100% FDI\nunder automatic route is allowable in construction-development projects, which\nincludes:<\/p>\n\n\n\n<ul><li>development of townships, <\/li><li>construction of residential\/commercial premises, <\/li><li>city\/regional level infrastructure,<\/li><li>&nbsp;Townships<\/li><li>roads or bridges, <\/li><li>educational institutes, <\/li><li>recreational facilities,<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Not Permitted:<\/strong><\/h2>\n\n\n\n<p><strong>&nbsp;<\/strong>FDI is not allowable\nin an entity which is involved or proposed to be involved in: <\/p>\n\n\n\n<ul><li>any Real Estate Business, or<\/li><li>construction of farmhouses, or<\/li><li>trading in transferable development rights<\/li><\/ul>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter\"><img decoding=\"async\" loading=\"lazy\" width=\"780\" height=\"490\" src=\"https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/05\/image-35.png\" alt=\"Real Estate Business\" class=\"wp-image-16896\" srcset=\"https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/05\/image-35.png 780w, https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/05\/image-35-300x188.png 300w, https:\/\/enterslice.com\/learning\/wp-content\/uploads\/2019\/05\/image-35-768x482.png 768w\" sizes=\"(max-width: 780px) 100vw, 780px\"\/><\/figure><\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Applicable Conditions for FDI in Real Estate Sector in India<\/strong><\/h2>\n\n\n\n<p>Following\nconditions should be taken care of:<\/p>\n\n\n\n<ul><li><strong>Minimum Area\nRequirement: <\/strong><\/li><\/ul>\n\n\n\n<p>There is no\nminimum land requirement in case of development of serviced housing plots.\nHowever, a minimum floor area of 20,000 square meters is required in case of\nconstruction-development projects.<\/p>\n\n\n\n<ul><li><strong>Amount of\nInvestment:<\/strong><\/li><\/ul>\n\n\n\n<p><strong>&nbsp;<\/strong>A minimum\nFDI of USD 5 million is required within six months of commencement of the\nproject. Please note that the commencement of the project will be the date of\napproval of the building plan\/layout plan by the relevant legal authority.<\/p>\n\n\n\n<ul><li><strong>Exit Route:<\/strong><\/li><\/ul>\n\n\n\n<p>The investor\nis allowable to depart from the investment on the completion of the project or development\nof roads, water supply, drainage, sewerage and street lighting.<\/p>\n\n\n\n<ul><li><strong>Compliance with other regulatory principles:<\/strong><\/li><\/ul>\n\n\n\n<p>The project\nshall be acceptable to the norms and standards, including land use requirements\nand terms of community facilities and shared facilities, as laid down in the\napplicable building control regulations, bye-laws, rules and other regulations\nof any government authority.<\/p>\n\n\n\n<ul><li><strong>Sale of plots which are developed:<\/strong><\/li><\/ul>\n\n\n\n<p>The Indian\ninvestee company will be allowable to sell developed plots only.
