Central Government Or Company To Fix Limit With Regard To Remuneration"},"content":{"rendered":"\n<p>Notwithstanding anything contained in this Chapter,\u00a0<span id='easy-footnote-1-80973' class='easy-footnote-margin-adjust'><\/span><span class='easy-footnote'><a href='https:\/\/enterslice.com\/learning\/act\/companies-act-2013\/section-200\/#easy-footnote-bottom-1-80973' title='The words &amp;#8220;the Central Government or&amp;#8221; omitted s. 69, ibid., (w.e.f. 12-9-2018).'><sup>1<\/sup><\/a><\/span>*** a company may, while according its approval under section 196, to any appointment or to any remuneration under section 197 in respect of cases where the company has inadequate or no profits, fix the remuneration within the limits specified in this Act, at such amount or percentage of profits of the company, as it may deem fit and while fixing the remuneration,\u00a0<span id='easy-footnote-2-80973' class='easy-footnote-margin-adjust'><\/span><span class='easy-footnote'><a href='https:\/\/enterslice.com\/learning\/act\/companies-act-2013\/section-200\/#easy-footnote-bottom-2-80973' title='The words &amp;#8220;which begins at or after the commencement of this Act&amp;#8221; omitted by Act 1 of 2018, s. 68 (w.e.f. 12-9-2018).'><sup>2<\/sup><\/a><\/span>*** the company shall have regard to&#8211;<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p>(a) the financial position of the company;<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p>(b) the remuneration or commission drawn by the individual concerned in any other capacity;<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p>(c) the remuneration or commission drawn by him from any other company;<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p>(d) professional qualifications and experience of the individual concerned;<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p>(e) such other matters as may be prescribed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Notwithstanding anything contained in this Chapter,\u00a0*** a company may, while according its approval under section 196, to any appointment or to any remuneration under section 197 in respect of cases where the company has inadequate or no profits, fix the remuneration within the limits specified in this Act, at such amount or percentage of profits [&hellip;]<\/p>\n","protected":false},"author":4,"featured_media":79763,"parent":79755,"menu_order":0,"template":"","format":"standard","meta":[],"categories":[11445],"tags":[1007],"acf":{"service_id":false},"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v14.6.1 - https:\/\/yoast.com\/wordpress\/plugins\/seo\/ -->\n<title>Section 200.
